As a general matter, you are not entitled to a tax deduction for mortgage interest unless you are legally liable for payment of the debt. It sounds as if you weren't, and therefore you shouldn't have gotten the deduction anyway. Of course, there are occasionally creative solutions to such issues, but that doesn't sound like a winner.
